24. September 2019. Priv.-Doz. DDr. Christian F. Schneider, Partner und Experte im öffentlichen Wirtschaftsrecht bei bpv Hügel Wien, hat in Bergthaler/Grabenwarter, Musterhandbuch Öffentliches Recht, erschienen bei MANZ, einen Beitrag zum Krankenanstaltenrecht veröffentlicht.

Dem bewährten Konzept des Musterhandbuchs folgend, enthält der Beitrag einen Überblick über die Rechtsmaterie sowie Musterschriftsätze für die wichtigsten krankenanstaltenrechtlichen Verfahren wie insbesondere Anträge auf Erteilung der Errichtungs- und Betriebsbewilligung für selbstständige Ambulatorien und bettenführende Krankenanstalten. Für die Praxis besonders bedeutend ist dabei die detaillierte Aufbereitung der Judikatur zur sog „Bedarfsprüfung“ – Krankenanstalten dürfen nämlich grundsätzlich nur errichtet werden, wenn ein Bedarf besteht. Mit seinem Beitrag zum Krankenanstaltenrecht knüpft Priv.-Doz. DDr. Schneider an seinen bereits 2017 im selben Handbuch erschienenen Beitrag zum Apothekenrecht an.
