COVID-19 Legal Update: Förderrichtlinien des Corona Hilfs-Fonds

Am 08.04.2020 wurde aufgrund des § 3b Abs. 3 des ABBAG-Gesetzes, BGBl. I Nr. 51/2014, zuletzt geändert durch das 3. COVID-19-Gesetz, BGBl. I Nr. 23/2020, die Verordnung des Bundesministers für Finanzen betreffend Richtlinien über die Ergreifung von finanziellen Maßnahmen, die zur Erhaltung der Zahlungsfähigkeit und zur Überbrückung von Liquiditätsschwierigkeiten von Unternehmen im Zusammenhang mit der Ausbreitung des Erregers SARS-CoV-2 und den dadurch verursachten wirtschaftlichen Auswirkungen geboten sind („Corona Hilfs-Fonds VO“), kundgemacht (BGBl. II Nr. 143/2020).

Gemäß § 1 der Corona Hilfs-Fonds VO hat die Ergreifung von finanziellen Maßnahmen durch die COVID-19 Finanzierungsagentur des Bundes GmbH („COFAG“), die zur Erhaltung der Zahlungsfähigkeit und zur Überbrückung von Liquiditätsschwierigkeiten von Unternehmen im Zusammenhang mit der Ausbreitung des Erregers SARS-CoV-2 und den dadurch verursachten wirtschaftlichen Auswirkungen geboten sind, den im Anhang zur Corona Hilfs-Fonds VO genannten Richtlinien („Corona Hilfs-Fonds Förderrichtlinie“) zu entsprechen.

Die Corona Hilfs-Fonds Förderrichtlinie gilt für Garantien, Direktkredite und Direktzuschüsse, wobei detailliertere Regelungen für die Direktzuschüsse einer gesonderten Förderrichtlinie vorbehalten sind, die sich derzeit in Ausarbeitung befindet.

Wir empfehlen die Voraussetzungen für die Unterstützungsleistungen und deren Wechselwirkungen sowie die einzugehenden Verpflichtungen vor der Inanspruchnahme zu prüfen. Besondere Beachtung sollte den Fixkostenzuschüssen insbesondere dann geschenkt werden, wenn ein Unternehmen den Erhalt von Direktzuschüssen oder eine bestimmte Höhe wichtigen Entscheidungen zugrunde legt. Hier können sich auf Basis der derzeit verfügbaren Informationen branchen- und unternehmensabhängig etliche Unklarheiten ergeben.
