“Erstauftraggeberprinzip” in the law on estate agents – article in immo aktuell by bpv Huegel-partner Michaela Pelinka and Christian Klein

In mid December last year, the governing parties announced an agreement on the so-called “Erstauftraggeberprinzip” in the law on estate agents, according to which the commission for the brokerage of rented flats will be paid by the party who first mandated the broker. In the meantime, this regulation has already been passed in the Austrian National Council, so that as of 1 July 2023 there will be a shift away from the previous model of dual brokerage in the area of lease brokerage. However, the financial relief for tenants touted by the governing parties is accompanied by a lack of information for those seeking housing.
