Der Weg in die Anwaltei – Florian Neumayr im Interview über seinen Weg

Wie genau wird man Rechtanwält:in?

Nach Absolvierung des ersten Abschnitts habe ich einen Sommer als Praktikant in der Kanzlei Dr. Posch in Wels gearbeitet. Ich durfte unglaublich viel sehen und vorbereiten – selbst ein Rechtsmittel hat mir Dr. Posch anvertraut. Die praktische anwaltliche Tätigkeit – nämlich die Unterstützung von Mandanten bei ihren vielfältigen Themenstellungen – hat mich dabei so fasziniert, dass für mich ab dem Zeitpunkt klar war, dass ich Rechtsanwalt werden möchte. Wenn Sie mich also fragen, wie genau man Rechtsanwält:in wird, dann war es jedenfalls in meinem Fall so, dass man am besten unmittelbar in eine Rechtsanwaltskanzlei eintaucht. Der formale Werdegang ist dann nur eine Frage des Fleißes und der Zeit. Die wesentlichen Schritte in Österreich, um weniger abstrakt zu sprechen, sind: abgeschlossenes Jus-Studium, Gerichtsjahr (wobei es sich dabei nicht um ein ganzes Jahr, sondern etliche Monate bei Gericht handelt), Konzipientenzeit in einer Kanzlei und Rechtsanwaltsprüfung.

Was sind die größten Hürden und wie meistert man diese am besten?

Da muss ich nochmal zu Fleiß und Zeit zurückkommen. Um Rechtsanwält:in in Österreich zu werden, bedarf es Ausdauer. Zunächst ist das Studium durchaus fordernd, und daran knüpft sich eine lange weitere Ausbildungszeit. Am besten ist es nach meiner Erfahrung, generell im Leben „aus der Not eine Tugend zu machen“. Dh, umgelegt auf den Werdegang, nicht einfach versuchen, das Mindestmaß möglichst schnell herunterzubiegen, sondern bewusst die Herausforderung suchen, die dann ja letztlich freiwillig gewählt ist und auch mehr Freude macht. So habe ich neben dem Grundstudium auch ein Doktorat in Wien gemacht, was mir den Weg zum Vergaberecht geebnet hat, das ich heute noch praktiziere. Weiters war ich zweimal im Ausland, und zwar einmal schon während des Studiums auf ERASMUS in Thessaloniki, was eine besonders spannende und erste internationale Zeit war. Dabei bin ich erstmalig auch mit dem Kartellrecht in Berührung gekommen, das damals so noch nicht in Österreich unterrichtet wurde. Kartellrecht ist seither der Fokus meiner anwaltlichen Tätigkeit. Weiters habe ich nach dem Studium ein Postgraduate in Nottingham gemacht, wo ich unter anderem internationale Konfliktlösung studiert habe.

Wie sieht Ihr momentaner Arbeitsalltag im Detail aus?

Zum Glück kann man von „Alltag“ erfreulich wenig sprechen. Die Fälle, mit denen man gerade als auf Kartell- und Wettbewerbsrecht sowie Konfliktlösung spezialisierter Anwalt konfrontiert wird, sind dergestalt vielfältig, dass sich ein Alltag kaum und auch nach mittlerweile vielen Jahren der Tätigkeit einstellt. Entsprechend schwer ist es auch, den „typischen Tag“ im Detail zu beschreiben. Immer geht es aber letztlich darum, in einem – mehr oder weniger – gegebenen Rahmen (aus Sachverhalt und anwendbaren Rechtsnormen) Argumente zu finden, die bestmöglich dem jeweiligen Thema des Mandanten gerecht werden. Es geht also um sachlich gekonntes Argumentieren – schriftlich etwa in Form von Schriftsätzen und in Verhandlungen mündlich.
