Wolfgang Berger specialises in public procurement law including legal protection proceedings, civil and construction contract law as well as public law.

Areas of specialisation
Wolfgang Berger has been active in public procurement law for over 20 years. He regularly advises public contracting authorities and sectoral contracting authorities in particular on the realisation of tenders and the execution of contracts. His legal advice also includes the drafting of contracts and measures to avoid claims for additional costs (anti-claim management). Wolfgang Berger advises bidders in particular in connection with participation in public tenders and in legal protection proceedings under public procurement law.

  • Ongoing advice to numerous public contracting authorities in the preparation and handling of various public procurement procedures, in particular in the areas of IT/technology, healthcare and construction
  • Conducting various negotiation procedures with prior publication for the procurement of software and hardware
  • Preparation of model tender documents, in particular for construction tenders
  • Legal support for legal protection proceedings under public procurement law on both the public contraction authority side and bidder side
  • Examination of contract amendments under public procurement law
  • Civil law review of additional cost claims
  • Preparation of expert opinions, in particular in the area of public procurement law and civil law
  • Advising bidders in the context of participation in public procurement procedures

Lectures
Wolfgang Berger regularly holds lectures in the areas of public procurement and construction contract law and is a permanent lecturer at the Academy for Law and Taxes (ARS). Wolfgang Berger also gives training courses and workshops for public contracting authorities.

Professional background
Wolfgang Berger completed his law degree in 2002 (University of Vienna). He then worked as a research assistant and as an associate at law firms specialising in public procurement law. Wolfgang Berger completed his doctoral studies in 2008 (University of Vienna). In 2009, he successfully passed the bar exam and then worked as a corporate lawyer at ASFINAG, where he was head of the public procurement law team in the legal and purchasing department. Since 2015 he has been working as an registered attorney-at-law in law firms specialising in public procurement law.
